1. General Risk Warning

Trading crypto assets carries a high degree of risk and is not suitable for every user. Derivative products, including perpetual swaps, futures, and options, add additional leverage, liquidation, complexity, and regulatory risks. You could lose more than your initial deposit. Before trading, carefully consider your investment objectives, experience level, risk appetite, and local legal restrictions.

2. Leveraged Trading Risks

Leveraged trading amplifies both gains and losses. A small market movement can result in substantial losses that may exceed the funds in your trading account. You are responsible for monitoring your positions and maintaining sufficient margin at all times.

Liquidation risk: If your account equity falls below the maintenance margin requirement, your positions may be automatically liquidated by the exchange at unfavorable prices.

3. No Financial Advice

Darvas does not provide investment advice within the meaning of Directive 2014/65/EU (MiFID II), Regulation (EU) 2023/1114 (MiCA), §1 (1a) sentence 2 no. 1a KWG / §2 (8) no. 10 WpHG (Germany), or the Spanish Texto Refundido de la Ley del Mercado de Valores. AI-generated trade plans, scenarios, and analytics are general-purpose informational tools and do not take into account your individual financial situation, objectives, or risk tolerance. Nothing produced by Darvas - including AI output, charts, or alerts - constitutes a personal recommendation, financial advice, tax advice, or solicitation to buy or sell any asset.

AI-generated analysis, trade suggestions, and technical indicators should not be relied upon as the sole basis for any trading decision. AI models can produce inaccurate, incomplete, or misleading outputs. Always perform your own independent research and analysis.

4. Past Performance

Past performance is not a reliable indicator of future results. Returns shown by AI scenarios, backtests, or historical data do not guarantee equivalent returns going forward. Crypto-asset markets are volatile and your capital is at risk.

5. Broker Connection Risks

When you connect your OKX account to Darvas via OAuth, you authorize Darvas to view your account data and submit user-confirmed orders to OKX through your own account. Darvas does not have access to withdraw funds, custody assets, pool orders, match orders, act as counterparty, or provide liquidity.

You acknowledge and accept the following risks related to broker connections:

  • Order execution: Orders sent through Darvas are executed by OKX on your own OKX account. Darvas only provides the software interface for user-directed order entry and does not guarantee execution price, fill rate, or order completion.
  • Network latency: Delays in network communication between Darvas and OKX may result in orders being executed at different prices than displayed.
  • System downtime: Either Darvas or OKX may experience outages. You should not rely solely on Darvas for managing open positions.
  • API changes: Changes to the OKX API may temporarily affect functionality. Always have direct access to your OKX account as a backup.

6. Third-Party Services

Darvas relies on third-party services including OKX (exchange), OpenAI (AI analysis), and others. These services are independent from Darvas, and their availability, accuracy, and performance are outside our control. Darvas is not responsible for any losses resulting from third-party service failures or data inaccuracies.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Darvas and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the platform, including but not limited to: trading losses, loss of profits, data loss, or business interruption.

You use Darvas entirely at your own risk. You are solely responsible for your trading decisions and their outcomes.

8. Regulatory Notice

Darvas operates as a software and trading terminal provider and is not authorised, registered, or supervised as a financial-services provider, investment firm, broker, dealer, exchange, order-matching venue, market maker, liquidity provider, crypto-asset service provider (CASP under Regulation (EU) 2023/1114 / MiCA), payment institution, or e-money institution by any financial regulator, including BaFin (Germany), the CNMV (Spain), the FCA (United Kingdom), the Turkish Capital Markets Board (CMB/SPK), or any equivalent authority. Crypto-asset trading and specific products such as margin, perpetual swaps, futures, options, earn, or structured products are not legal or available in every jurisdiction and may be restricted, regulated, or prohibited where you reside. You are responsible for verifying the legality of your activity under your local law before using Darvas.
